法庭消息︰男子盜取IP上網購物3.6萬元

【on.cc專訊】一名23歲曾就讀大學電腦工程的加納籍男子Tachie Kwame，於今年2月在九龍城寓所，偷取該區住戶的上網IP，然後再用假信用卡上網購物，涉款3.6萬元。被告承認不誠實使用電腦等3項罪名，餘下一條管有假卡設備被告不認罪，案件押後至7月預審，判刑亦押後。商業及罪案調查科主管表示，今次是首宗利用其他住戶的無線路電器盜取IP上網案，他呼籲住戶要為無線上網設密碼，以免被不法之徒利用。

【明報專訊】在網上討論區聲言要用自殺式炸彈襲擊「迪迪尼」及美國領事館的年輕髮型師早前承認浪費警力，裁判官昨判刑時指明白被告沒有襲擊上述地方的意圖，但直斥被告「開玩笑都要有個限度」，需要為其愚蠢行為負責，[color=red]故判以120小時社會服務令及賠償1萬元[/color]。
被告林嘉樂(22歲)的報告指林精神健全，亦沒有使用暴力傾向。裁判官林嘉欣相信被告沒意圖實踐於討論區中虛報的襲擊行動，但指出，社會必須在言論自由及公眾安全之間找出平衡點，縱使只是開玩笑，亦要知道分寸。裁判官認為：「在生命中有些事情不宜拿來開玩笑，好像『恐怖主義』、『美國領事館』及『炸彈』等字眼，在這個世代尤其敏感。」
裁判官認為被告紀錄良好，但須為自己的愚蠢行為負責，除120小時社會服務令外，報稱月薪微薄的被告依然[color=red]要就警力浪費作賠償，並須於兩個月內繳清。[/color]
辯方大律師昨求情時指出，被告在討論區自稱「真主教恐怖分子」，卻於留言中選用希特勒的圖像，顯然並非一個真正伊斯蘭教徒的作為，事件由始至終都是玩笑一場，只是被告低估了受眾的認真程度。

•男子電腦儲兒童鹹相候判 2007 06 15
【蘋果報訊】男子聲稱一時貪玩，從互聯網下載兒童色情照片及影片，作個人觀賞用，以為神不知鬼不覺，惟警方調查後，突擊搜查其寓所，發現電腦內儲存376幀照片及73段影片檔案，拍攝對象約8至16歲，內容不乏性交甚至性虐場面。涉案男子昨日於觀塘裁判法院承認管有兒童色情物品罪，還柙至下月9日判刑。 辯方律師昨日求情時，懇求法庭先為被告梁震熙（22歲）索閱社會服務令報告始判刑，惟裁判官斷言有關控罪沒可能只判處社會服務令，拒絕要求，反而索閱心理及精神科專家等報告。

強姦案兩男女或加控罪

【東方報訊】已婚女文員涉嫌協助男友人強姦另一女子，繼而揭發該對男女涉嫌連女被告的親母也欲迷姦一案，涉案男女昨再於屯門法院再訊。
控方在庭上透露，警方在兩被告的電腦硬盤及記憶體中，發現逾百張相片及廿多段影片，與現時控罪有關；另外，疑遭男被告以性愛照片勒索的兩名男子，先後已在認人手續中認出兩名被告，控方表明不排除會加控兩人其他控罪。
卅二歲黃姓女被告，被控在今年一月十三日，在她屯門邁亞美海灣的住所內，協助及教唆四十四歲男被告陳俊圖強姦一名女友人。而陳則被控以一項強姦罪。昨穿上同款Ｔ恤應訊的兩名被告，均無提出保釋申請，法庭將案押後至七月廿六日等待律政司意見，期間下令兩人繼續還押懲教署看管。
逾百相片與控罪有關
•控方在庭上透露，[color=red]警方商業罪案調查科的先進科技組，在兩名被告的電腦硬盤及記憶體中，發現千多張相片及百多段錄影短片，其中分別有百多張相片及廿多段短片具有搜證價值，與現時所控控罪相關。[/color]
另外，陳又涉嫌以女被告跟另外兩名男子性交的相片，勒索該兩名男子各五千元。該兩名遭勒索的男子，在警方安排的認人手續中已先後認出兩名被告。

我昨日打過去hkbn 既cs 問問, 首先我係問流量 & 開server 既問題, since 我個同事畀hkbn cut 線個時個cs 同佢講話因為個system check 到佢大流量, 所以cut 左條線, 之後先收到信話佢非法下載... 而我問個cs 佢承應流量大system 係會cut 線, but 我問佢何謂流量大, 佢又答唔到實質既數畀我, 而我問佢我登記個時所簽既表格裡面既第22 條: "客戶不能以任何途徑利用寬頻服務運作任何伺服器..... 該等伺服器類作業包括但不限於運作email server, web server, ftp server, dhcp server, proxy,.........." 咁裡既"包括但不限於" 係不限制 定係不限止, 個cs 係答我唔可以開server, 所以如果開server 以過大流量係會cut 線, 咁我問番佢咁我無開ftp server, 用msn send file 畀人(我係話我成日要share 番d 相畀人, 大家都知家陣d 相既size 有幾大ga la, 分分鐘都成gb, 唔係買咁大既memory card 把托呀), 個cs 答番我話lei 個情況都會cut, 總之流量大就會cut... but 佢紿終都無答到我點樣流量大, since 我申請bb25, 個頻寬上限係25mb, 咁個流量又點會超出lei 個range, 而佢地又話係無限寬頻, d 條款又無話過有流量限制, 又無話限制幾多, 剩係話點快點快, 一句流量大就cut, 咁即係點呀, 又話有速度保證, 如果到時係咁cut 我仲咩保證, 我諗保證cut 線就有佢份....
之後我搵番個sales, 佢叫我逼個cs 講番條數, since 佢話佢同我講話會唔會cut 都無用, 話最好打上cs 到問清楚, mark 低番cs 個staff no, mark d 時間, since 會有錄音, 問清楚先決定, since 佢話都唔想個客用得唔開心.... 我心諗個sales 講既先公道ma, 所以我再打個去個128100, 個邊既cs 話轉頭覆我, but 到今日都收唔到電話law, 我諗我聽日得閒會再打去問清楚再決定轉唔轉.....[/quote]
