Two mothers have told The Sunday Telegraph that their pain at losing their children was made worse by not knowing the grounds on which judges took the decisions. Pauline Goodwin's baby was taken from her but she was denied a copy of the judgment. The court service has now apologised Both women had their requests for copies of the judgments turned down repeatedly. As a result, they were prevented from launching legal battles to win their babies back, because appeals cannot be lodged without -written judgments. Critics claimed that the cases are an extreme example of the secrecy that runs throughout the family court system. Earlier this summer, the Government abandoned plans to open up hearings to the media. John Hemming, the Liberal Democrat MP and chairman of Justice for Families, said: "It seems quite strange that somebody can have their child removed and adopted, and the system will not give reasons. "This arises from the secrecy of proceedings and the fact that people are allowed to misbehave professionally in the family courts without any fear of sanctions against them." advertisement The cases are the latest in a series highlighted by this newspaper which have raised concerns about the workings of the family courts and social services. It included a professional couple who had their daughter taken away because the mother has a history of mental illness and the father was "confrontational" towards social workers, while another couple were told they cannot have their two daughters back despite being cleared of allegations of abuse. Last year, 2,120 babies were taken for adoption before their first birthday, almost three times as many as a decade ago. Adoptions leapt after councils were offered cash incentives to increase the number. One of the latest cases involved Pauline Goodwin, 39, from Merseyside, who suffered a breakdown after her marriage ended. As she struggled to cope, her baby girl, born in 2005, was taken away by social services at birth. At a court hearing in June last year, held at a time when she was temporarily homeless, Judge Wallwork ruled at Liverpool Family Court that the baby should remain in foster care. The mother says she was told that despite the outcome of the case, the judgment would not be critical of her. However, in the 14 months since the hearing, her repeated requests to obtain a copy of the judgment have proved fruitless. She has been told by social workers that her daughter has now been adopted. She said: "They had my baby adopted, then they said they make no findings against me, but they won't give me the court order. I need the judgment because I want to lodge an appeal. It's supposed to be within 28 days but it has been more than 12 months. "If they give me the transcripts I can prove the whole thing was wrong, and my baby wouldn't be where she is now, she would be with me." Sharon Harkness, 37, also from Merseyside, won the first round of her courtroom battle when social workers tried to take her baby son away. In August 2005, at the High Court in London, Mr Justice Holman turned down a bid by a local authority to take the boy, then only three months old, into foster care. However, at Liverpool Family Court in November, Judge Roddy reversed the earlier decision and granted the council a care order. (Less)

The child�s well being would be neglected as society deemed people with disabilities unable to care for themselves let alone, cope with parenthood. Consequently, if a girl with a disability became pregnant, the pregnancy was often recommended to be terminated, regardless of her rights and wishes. Children born of disabled parents, particularly of parents with intellectual disability were frequently removed at birth by protective services authorities because it was believed to be in the best interests of the child. Feedback received by the Yooralla Parents With a Disability Community Project at the 1996 Forum and comments we have received from parents with disabilities since indicates that some parents with physical, sensory, psychiatric and intellectual disabilities fear intervention from Child Protection Services. Whether these fears are realised will depend on the nature and extent of the individuals disability, the strength of their support networks and the attitudes of the community around them. For example, if a notification is made against a parent with a disability, particularly a mother with an intellectual disability, the mother can find she is placed under intense scrutiny to prove why the child should not be removed from her care. (Fuller, 1996). The distinction between protective concerns and value judgements about the person�s capabilities as a parent can become blurred, leading to stringent conditions being required to be met before the child is returned to the parent�s care. (The Advantage Project, 1996). If Child Protection authorities are seen to impose conditions on parents with a disability beyond those required of other parents, this action could amount to disability discrimination. In 1996 the Victorian Department of Human Services (DHS) Disability Services Branch acknowledged that parents with an intellectual disability required additional support and "�funded �a parenting program specifically for parents with an intellectual disability." (Department of Human Services, 1997). The development of this program and subsequent manual is a good start because it identifies some very useful parenting strategies for use by parents with an intellectual disability including support groups to enable them to become more effective parents. The model used primarily targets parents who have experienced involvement of Child Protection prior to joining the program. The pilot program highlighted the demand for parenting skills programs and support for parents with a range of disabilities. This resource manual goes some way towards addressing these parenting needs. However, further work must be done to properly address the various parenting needs of all disabled people with dependent children. (Less)

Instead of admitting the serious failings which had damaged the lives of some of the most vulnerable youngsters in the region, the council set about trying to defend the indefensible. Now, 18 months and £1m of council taxpayers' money later, Wakefield Council has implicitly admitted the truth of what was printed; care of children in its homes waslittle short of shambolic. The six whistleblowers spoke out to the Yorkshire Post when no one else would take their concerns seriously. The council response was to initially close the home they worked in, then sack them, before trying -- and failing -- to get them placed on a Government blacklist of workers more usually associated with sex offenders who pose a risk to children. The "crime" of those staff -- Clive Womersley, Grant Morley, Karen Allcock, Doug Lafferty, Vincent Felix and Keith Bayliss -- was to reveal what had been happening in local authority children's homes under Wakefield Council's watch. The revelations included children as young as 12 being allowed to engage in sexual relationships; a 16-year-old girl at risk of prostitution, whose parents had both committed suicide, being thrown out of care with nowhere to go; and a care worker using petty cash to buy and then smoke drugs with children he was meant to be looking after. Among other revelations were: a boy with learning disabilities, totally unsuited to a temporary, respite care placement at a troubled children's home, being subsequently sexually assaulted by two other boys; failures in criminal record checks; staff being inadequately trained; and a series of violent incidents leading to staff being injured because managers refused to listen to their concerns about the inappropriate placing of disturbed children who needed highly specialised care. The council's initial resp-onse to the Yorkshire Post's revelations was to claim, via a joint statement with West Yorkshire Police, that everything had been fully investig-ated -- including by the NSPCC -- and that these in-vestigations concluded the council had acted appropriately. It said that "safety of children is our first priority". The council leader, Peter Box, and cabinet member responsible for children in care, Wayne Jenkins, then went further and publicly disputed the accuracy of the Yorkshire Post reporting during a meeting of the full council, suggesting the local authority had been unfairly maligned. At the same time the Wakefield area's four local MPs had been placated by the council's assurance to them that the complaints about management of children's homes had been fully investigated by the NSPCC. That claim was shown to be a sham in August last year when a damning report to Children's Rights Director Roger Morgan on how Wakefield Council had treated the whistleblowers revealed that the local authority had "perversely" blocked the NSPCC from carrying out a full inquiry. The council's attempt to defend the whistleblowers employment tribunal claim was clearly falling apart but it still took another year -- and tens of thousands of pounds spent on employing an expensive team of lawyers -- before the authority would effectively own up. All along, the whistleblowers did not waiver from their determined position that they had simply told the truth and been sacked for it. The stress and financial strain has been enormous but the six, who all had unblemished disciplinary records, always maintained they did the right thing and were perfectly prepared to face the council at a tribunal. In an interview last year, Clive Womersley, a residential care worker with 18 years' experience, summed up their stance: "While we are suffering greatly now, it's nowhere near what those children went through.
