Dr. Abd Al-Hamid Al-'Ubeidi: There is no minimum marriage age for either men or women in Islamic law. The law in many countries permits girls to marry only from the age of 18. This is arbitrary legislation, not Islamic law. Why? Because there might be cases in which it is impossible to keep the girl [single] until the age of maturity.
For example, in Bosnia-Herzegovina, the Serbs killed many Albanian Muslims, and there are many mass graves there. [Muslim] families fled from that war, and so did small children, who were not yet at the age of marriage. But if a man takes such a girl in, he might desire her, and eventually commit a sin, even though his intentions were noble. So he can formally marry her, but without having sex with her. She will remain like that until she grows up, and then someone will ask to marry her, or he will find her a husband -- this happens in many Islamic countries with girls from Bosnia-Herzegovina -- and when he finds her a husband, he will divorce her, so that she can marry again. In such a case, there should be no waiting period. So there is no need for the girl to be of age.
Most of the time we act according to what is acceptable to most people, and indeed, most men do not marry a girl until she is of age. In some Islamic countries, the age of maturity can be 8 or 10 years. In Yemen, a girl might get her period at the age of 8. In cold countries, such as Russia, Belarus, Scandinavia, New Zealand, Canada, and so on, a girl might not reach maturity until she is 22 years old. She might not get her period until then. Therefore, the greatness of Islamic law is manifest in the fact that marriage is not just for pleasure. True, it is the basic objective for marriage, but there are some cases that require solutions.

Many criminals, the enemies of Islam, ask: "How could the Prophet Muhammad, at 52 years of age, marry 'Aisha when she was only 8 years old, and consummate the marriage when she was 9 years old?" I say to them: People who live in glass houses shouldn't throw stones. Why do you permit your young girls to fornicate? They consider it one of their liberties. Therefore, in these stupid countries, you rarely find girls aged 10 or 12 who are still virgins. They permit this. They have even legislated laws stating that if a girl is under the age of 18, and her girlfriend [sic] or whatever has had sex with her, she has the right to have an abortion. How can you permit the outcome without accepting the cause? Why do you allow your girls to have sex and say this is an individual liberty? It is okay to fornicate with girls there or force them to have sex, and so on, and they have the right to have an abortion. If you permit all this before the age [of 18], without a marriage contract and without any legal grounds -- how come you forbid marriage?

The Rt Rev John Packer told a debate on the rule of law in the House of Lords that it is important religious communities, including Islam, are "not denied the right to uphold ethical and moral standards where they do not infringe basic human rights". His comments come in the light of the Archbishop of Canterbury's controversial remarks about Sharia law. Bishop Packer referred to the Church retaining the right not to marry people who have been divorced and to Jewish Beth Din courts and Somali customary law which enable "disputes to be settled in the security of a particular cultural group without recourse to the secular courts" and provide a "safe haven for independent adjudications". He said he regretted the recent decision to force Roman Catholic adoption agencies to place children with gay couples "overriding the conscientious rights of the Roman Catholics concerned". "There is much within the practices and legal systems of different communities and cultures within our land which we ought to welcome, as well as that which is against human rights which we need to condemn," he said. But, as I hope to suggest, the issues that arise around what level of public or legal recognition, if any, might be allowed to the legal provisions of a religious group, are not peculiar to Islam: we might recall that, while the law of the Church of England is the law of the land, its daily operation is in the hands of authorities to whom considerable independence is granted. And beyond the specific issues that arise in relation to the practicalities of recognition or delegation, there are large questions in the background about what we understand by and expect from the law, questions that are more sharply focused than ever in a largely secular social environment. I shall therefore be concentrating on certain issues around Islamic law to begin with, in order to open up some of these wider matters. Among the manifold anxieties that haunt the discussion of the place of Muslims in British society, one of the strongest, reinforced from time to time by the sensational reporting of opinion polls, is that Muslim communities in this country seek the freedom to live under sharia law. And what most people think they know of sharia is that it is repressive towards women and wedded to archaic and brutal physical punishments; just a few days ago, it was reported that a 'forced marriage' involving a young woman with learning difficulties had been 'sanctioned under sharia law' -- the kind of story that, in its assumption that we all 'really' know what is involved in the practice of sharia, powerfully reinforces the image of -- at best -- a pre-modern system in which human rights have no role. The problem is freely admitted by Muslim scholars. 'In the West', writes Tariq Ramadan in his groundbreaking Western Muslims and the Future of Islam, 'the idea of Sharia calls up all the darkest images of Islam...It has reached the extent that many Muslim intellectuals do not dare even to refer to the concept for fear of frightening people or arousing suspicion of all their work by the mere mention of the word' (p.31). Even when some of the more dramatic fears are set aside, there remains a great deal of uncertainty about what degree of accommodation the law of the land can and should give to minority communities with their own strongly entrenched legal and moral codes. As such, this is not only an issue about Islam but about other faith groups, including Orthodox Judaism; and indeed it spills over into some of the questions which have surfaced sharply in the last twelve months about the right of religious believers in general to opt out of certain legal provisions -- as in the problems around Roman Catholic adoption agencies which emerged in relation to the Sexual Orientation Regulations last spring. ... cont'd ---------------- BBC ---------------- The Bishop of Hulme, the Rt Rev Stephen Lowe, robustly defended Rowan Williams and said he was appalled at the "kneejerk" reaction to a serious piece of academic work. "We have probably one of the greatest and the brightest Archbishops of Canterbury we have had for many a long day," he told BBC Radio 4's World at One. "The way he has been ridiculed, lampooned and treated by some people, and indeed some of the media within this process, is quite disgraceful. It is a shame on our nation." The bishop said Williams had raised a vital issue for a society facing many multicultural challenges. "He has a responsibility as leader of the established church in making sure the spiritual life of this nation is as healthy as possible. I believe he was doing that yesterday. "He wants Sharia law but not stoning. But you can't pick and choose." Sadly, just as the experts and politicians have woken up to the dangers of multiculturalism, the Archbishop seems to be belatedly latching on to it. By describing the principle of "one law for everybody" as "a bit of a danger", Dr Williams showed how out of touch he is. Legal equality, like freedom itself, cannot be diluted or overridden. It has to be asserted, insisted upon and fought for in every generation. If Dr Williams does not believe this, he is in the wrong job. Perhaps the greatest irony is that a prelate who has been strangely reluctant to provide strong moral leadership to his own flock is so ready to take such a controversial stand over the affairs of another religion. The Archbishop of Canterbury, Dr. Rowan Williams gave the foundation lecture at the Royal Courts of Justice
The title of this series of lectures signals the existence of what is very widely felt to be a growing challenge in our society -- that is, the presence of communities which, while no less 'law-abiding' than the rest of the population, relate to something other than the British legal system alone. But, as I hope to suggest, the issues that arise around what level of public or legal recognition, if any, might be allowed to the legal provisions of a religious group, are not peculiar to Islam: we might recall that, while the law of the Church of England is the law of the land, its daily operation is in the hands of authorities to whom considerable independence is granted. And beyond the specific issues that arise in relation to the practicalities of recognition or delegation, there are large questions in the background about what we understand by and expect from the law, questions that are more sharply focused than ever in a largely secular social environment. I shall therefore be concentrating on certain issues around Islamic law to begin with, in order to open up some of these wider matters.
